Brandon Padilla Aguilera, 26, of Barstow, was driving the white sedan home from his grandmother’s funeral with his nonverbal young son, Xavier, on Sept. 18 when the father made the fatal decision to try to plow across a flooded street.

The car quickly became submerged in water, and the terrified father got out with Xavier, but the rushing waters eventually snatched the child from him, authorities said.

The father ended up on a piece of land and was quickly rescued, while Xavier’s body was found the next day in a flood control channel.

The father was heading home with his son at that time.

Last week, a month after the tragedy, Padilla-Aguilera was taken into custody, and on Tuesday, the San Bernardino County Sheriff’s Department took him into custody on one count on suspicion of murder, according to a statement from the Barstow Police Department.

“Over the course of the month-long investigation, investigators spoke with witnesses and collected evidence. Based on the evidence obtained, investigators issued an arrest warrant for him,” cops said in a statement.

The San Bernardino County District Attorney’s Office told The Post later Tuesday that it ended up charging the suspect with one count of vehicular manslaughter with gross negligence and one count of child abuse under circumstances likely to cause great bodily injury or death.
