An Atlanta carjacking victim has been arrested after shooting a boy who was breaking into his car.
Affiliated officials said Fox 5 Atlanta Police responded just before 3 a.m. to a shooting of a person in Fairborn Mays, about 20 miles south of downtown.
When Atlanta Police Department officers arrived, they found a boy under the age of 18 with a gunshot wound to his foot, according to the report.
Police said the boy admitted that he was shot after breaking into a car.
He was taken to Children’s Hospital and is expected to survive.
Yochai Carter, 51, who owned the car, told authorities the shooting occurred when he confronted the boy, the outlet reported.
Carter was later arrested and charged with aggravated assault, police said.
He was booked into the Fulton County Jail.
Under Georgia law, there is a statute that covers “the use of force in defense of property other than a residence.”
Any person has the right to threaten or use force when he or she reasonably believes it is necessary to prevent or stop criminal interference with property lawfully owned by him, in accordance with the law.
However, the use of force intended or likely to cause death or great bodily harm is not justified to protect property, unless the person using the force reasonably believes that such force is necessary to prevent a “forcible felony,” according to Georgia law.
Georgia also has a “no duty to retreat” law, which states that those who use force in self-defense, home defense, or property defense do not need to retreat.
Police did not confirm whether self-defense laws applied in Friday’s case, according to the report.
